SeniorGPT – Terms of Use

1. Description of the Service

SeniorGPT is an AI-powered assistant designed to help older adults with everyday questions, technology support, and light cognitive exercises. The Service is provided for informational and support purposes only and does not replace professional, medical, legal, financial, psychological or any other specialized advice. The Service may generate incorrect or incomplete content; you remain responsible for how you act on any information provided.

2. Eligibility

You must be at least 18 years old to use the Service, or use it under the supervision and responsibility of a parent, guardian, or caregiver. By using the Service, you represent and warrant that you meet this requirement.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use SeniorGPT on Apple-branded devices that you own or control, in accordance with the Apple App Store Terms of Service.

You may not:

• Copy, modify, adapt or create derivative works based on the app or the Service.
• Reverse engineer, decompile, disassemble or attempt to derive the source code of the app, except to the extent expressly permitted by applicable law.
• Rent, lease, lend, sell, sublicense, distribute or otherwise transfer the app or any rights to it.
• Circumvent or attempt to circumvent any technical protection or usage limits in the Service.

We reserve all rights not expressly granted to you in these Terms.

4. Account, Access and Security

You are responsible for maintaining the confidentiality of any device or account you use to access the Service and for all activities that occur under your access. You agree to use the Service only for lawful purposes, promptly notify us of unauthorized access, not impersonate others, and avoid compromising the security, integrity or proper functioning of the Service. We may suspend or terminate access if we reasonably believe your use poses a risk.

5. Subscriptions, Free Trials and Billing

• SeniorGPT may be offered via auto-renewable subscription plans (for example, weekly, monthly and annual plans). The prices, durations and any free trial periods are displayed in the app and on the App Store at the time of purchase.
• Payment is charged to your Apple ID account upon confirmation of purchase.
• Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the cost of the selected plan.
• You can manage or cancel your subscription at any time in your Apple ID / App Store account settings.
• We do not manage cancellations directly and cannot issue refunds for purchases made through the App Store. Any refunds are subject to Apple’s policies and applicable consumer law.
• Prices may change. If they do, you may cancel before the new price applies.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national or international law or regulation.
• Generate, upload or share content that is illegal, abusive, defamatory, hateful, discriminatory, obscene, or otherwise harmful.
• Harass, threaten, exploit or harm other people.
• Attempt to gain unauthorized access to accounts, systems or networks.
• Interfere with or disrupt the integrity or performance of the Service.

We may investigate suspected misuse and may suspend, restrict or terminate your access if we reasonably believe you have violated these Terms.

7. No Medical, Emergency or Professional Advice

SeniorGPT may generate suggestions, explanations or guidance, but it does not provide medical, psychological, psychiatric, therapeutic, legal, financial, or emergency advice. It is not a substitute for consultation, diagnosis, treatment, or care from qualified professionals. Do not rely on the Service for medical decisions or emergencies. In case of emergency, call your local emergency number immediately.

8. Privacy and Data

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge and agree that we may process your data as described there, including basic purchase information from Apple ID, technical and usage data, and content you submit or generate in chats. You are responsible for not sharing sensitive personal information beyond what you are comfortable with, especially when using the app on behalf of another person.

9. Intellectual Property

The Service, including the app, underlying software, design, text, graphics, logos, trademarks and other content, is owned by Vini Labs LLC or its licensors and is protected by intellectual property laws. Except for the limited license in Section 3, you are not granted any rights in or to the Service or any content or IP of Vini Labs LLC or its licensors. You may not remove or alter copyright, trademark or proprietary notices.

10. Third-Party Services and Links

The Service may use or interact with third-party technologies and services (AI providers, analytics, Apple infrastructure). Your use may be subject to additional terms and privacy policies of those third parties. We are not responsible for the content, availability, security or practices of third-party services. Links are provided for convenience only; you access them at your own risk.

11. Termination and Suspension

We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we decide to discontinue or significantly modify the Service. You may stop using the Service at any time and uninstall the app. Termination or suspension does not give you an automatic right to a refund unless required by law or Apple’s policies.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not guarantee any particular results. Some jurisdictions do not allow the exclusion of certain warranties; in that case the exclusions apply only to the extent permitted.

13. Limitation of Liability

To the maximum extent permitted by law, Vini Labs LLC, its affiliates, directors, officers, employees, and agents shall not be liable for indirect, incidental, consequential, special, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunities, arising out of or in connection with your use of or inability to use the Service. Where liability cannot be excluded by law, it is limited to the total amount you have paid (if any) for access to the Service in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability where the law does not allow.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. If you are a consumer residing outside the United States, you may also be entitled to mandatory consumer-law protections of your country. Disputes shall be submitted to the state or federal courts located in New Mexico, unless mandatory consumer rules provide otherwise.

15. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will update the “Last updated” date and, where appropriate, provide notice through the app or our website. Unless required by law, changes take effect when published. Your continued use after they become effective constitutes acceptance. If you do not agree, stop using the Service and uninstall the app.
